It’s already February, and chances are, most of us have already broken our New Year’s Resolutions. But no matter the time of year, when it comes to your ediscovery workflow, it’s never too late to trim the data you're collecting from messaging platforms and other SaaS applications.

Workplace complaints are serious. Even if a claim doesn’t lead to disciplinary action, the fact that an employee has made an accusation usually indicates workplace problems that need to be addressed for productivity, morale, and quality of work life.

Today is the 78th anniversary of the liberation of Auschwitz-Birkenau, the largest of the Nazi death camps. On this Holocaust Memorial Day, we remember all of those who were killed in genocides across the world. The most infamous of these genocides is the Holocaust, where six million Jews were killed in death camps, alongside other marginalized groups such as the Roma, disabled people, homosexuals, and political enemies. There have been a number of other genocides across the world since 1945, including in Cambodia, Rwanda, Bosnia, Darfur, and the Uyghur genocide in China, where people have been targeted and killed based on their ethnicity or religion.

Let’s face it, if litigation is imminent and you’re preparing for the discovery process, friction has already taken place between opposing parties. But that’s not what I mean when I’m talking about “frictionless ediscovery.”

It’s that time of year again when people are pulling out their crystal balls and doing their best to predict the future of what we’ll see in the ediscovery industry in 2023. I mean who doesn’t want to know what to look out for down the road? So in that spirit, here are some things Hanzo has been paying attention to as we move into a new year.

If another company claims that it was the first to invent a piece of your intellectual property (IP), would you be ready to respond with the design notes, sketches, and troubleshooting discussions your team generated during development? With remote workforces using dozens of SaaS applications to design new products and develop new ideas, proving ownership of IP can be a harder task than many companies expect.

HR Investigations tend to happen quickly, with the triggering event setting things into motion and demanding some kind of response almost immediately. There is also a desire to resolve the issue in short order. However, when things are moving this fast, errors can arise. This is why having repeatable processes in place is of key importance.

With that in mind, here are 4 best practices for conducting an HR Investigation:

Develop an Investigation Plan

The seriousness, complexity, and potentially delicate nature of internal investigations demand careful planning and organization. “Winging it” or taking an ad hoc approach to an investigation is not a viable approach. Therefore, once an investigator has been assigned to a matter, they must create a plan for each facet of the investigation.
